### sec.305 Altering road levels by a local government
The chief executive may require a local government having control of a road to alter the level of the road for—
busway transport infrastructure works; or
the management or operation of a busway.
However, the chief executive—
must consult with the local government about the nature and extent of the alteration of the level of the road before the alteration is started; and
subject to an agreement between the chief executive and the local government arising out of the consultation, pay all reasonable costs incurred by the local government in altering the road level.
The local government must comply with the chief executive’s requirement.

(sec.305-ssec.1) The chief executive may require a local government having control of a road to alter the level of the road for— busway transport infrastructure works; or the management or operation of a busway.
(sec.305-ssec.2) However, the chief executive— must consult with the local government about the nature and extent of the alteration of the level of the road before the alteration is started; and subject to an agreement between the chief executive and the local government arising out of the consultation, pay all reasonable costs incurred by the local government in altering the road level.
(sec.305-ssec.3) The local government must comply with the chief executive’s requirement.
- (a) busway transport infrastructure works; or
- (b) the management or operation of a busway.
- (a) must consult with the local government about the nature and extent of the alteration of the level of the road before the alteration is started; and
- (b) subject to an agreement between the chief executive and the local government arising out of the consultation, pay all reasonable costs incurred by the local government in altering the road level.
