### sec.258 Impact of particular development and railways
This section applies if the chief executive is—
the assessment manager or a referral agency for a development application; or
the responsible entity or a referral agency for a change application.
Also, this section has as its purpose ensuring—
the safety and operational integrity of railways and future railways; and
that development addresses impacts on the development from environmental emissions generated by railways or future railways.

For performing the chief executive’s functions as assessment manager, responsible entity or referral agency, the chief executive must consider the extent to which the proposed development satisfies the purpose mentioned in subsection (2) .
Subsection (3) is in addition to, and does not limit, the Planning Act , sections 55 , 81 , 81A and 82 .
