### sec.167 Watercourses
To carry out railway works, an accredited person may, with the chief executive’s written approval—
divert a watercourse; or
construct a watercourse, whether temporary or permanent.
In deciding whether to approve the diversion of a watercourse, the chief executive must consider the effect the works would have on the watercourse’s physical integrity and flow characteristics.
Subsection (2) does not limit the matters the chief executive may consider.

(sec.167-ssec.1) To carry out railway works, an accredited person may, with the chief executive’s written approval— divert a watercourse; or construct a watercourse, whether temporary or permanent.
