### sec.109 Definitions for pt 2 In this part— associated person , of an investigator, means any of the following— if the investigator is a corporation—the corporation’s chief executive, secretary or directors; the investigator’s employees or partners who are individuals; a person who is an agent of, or contractor for, the investigator, and engaged in writing for the purposes of the investigator’s authority; employees of an agent or contractor mentioned in paragraph (c) ; if a person mentioned in paragraph (c) is a corporation—the corporation’s chief executive, secretary, directors or employees. authority means— if the chief executive is the relevant person—the authority to enter land under section 109A ; or if an investigator is the relevant person—a rail feasibility investigator’s authority. s 109 def authority sub 2011 No. 12 s 38 investigator means a person who holds an authority. relevant person means the chief executive or an investigator. s 109 def relevant person ins 2011 No. 12 s 38 (2) s 109 prev s 109 ins 1994 No. 32 s 10 exp 1 July 1994 (see prev s 109(2)) AIA s 20A applies (see prev s 240(1)) pres s 109 ins 1998 No. 43 s 9 - (a) if the investigator is a corporation—the corporation’s chief executive, secretary or directors; - (b) the investigator’s employees or partners who are individuals; - (c) a person who is an agent of, or contractor for, the investigator, and engaged in writing for the purposes of the investigator’s authority; - (d) employees of an agent or contractor mentioned in paragraph (c) ; - (e) if a person mentioned in paragraph (c) is a corporation—the corporation’s chief executive, secretary, directors or employees. - (a) if the chief executive is the relevant person—the authority to enter land under section 109A ; or - (b) if an investigator is the relevant person—a rail feasibility investigator’s authority.
