### sec.28H Minister to make and publish guideline
The Minister must make, and publish on the department’s website, a guideline about the process for—
attaching a freehold instrument to a local government’s planning scheme; and
amending or repealing a freehold instrument.
The guideline must make provision for the local government to do all of the following things before attaching a freehold instrument to its planning scheme—
publish a notice about the freehold instrument in a newspaper or other publication circulating generally in the local government’s area at least once;
carry out public consultation about the freehold instrument;
give the Minister a notice summarising the matters raised during the public consultation and stating how the local government or the trustee dealt with the matters.

(sec.28H-ssec.1) The Minister must make, and publish on the department’s website, a guideline about the process for— attaching a freehold instrument to a local government’s planning scheme; and amending or repealing a freehold instrument.
(sec.28H-ssec.2) The guideline must make provision for the local government to do all of the following things before attaching a freehold instrument to its planning scheme— publish a notice about the freehold instrument in a newspaper or other publication circulating generally in the local government’s area at least once; carry out public consultation about the freehold instrument; give the Minister a notice summarising the matters raised during the public consultation and stating how the local government or the trustee dealt with the matters.
- (a) attaching a freehold instrument to a local government’s planning scheme; and
- (b) amending or repealing a freehold instrument.
- (a) publish a notice about the freehold instrument in a newspaper or other publication circulating generally in the local government’s area at least once;
- (b) carry out public consultation about the freehold instrument;
- (c) give the Minister a notice summarising the matters raised during the public consultation and stating how the local government or the trustee dealt with the matters.
