### sec.49 Particular development exempted Section 34 does not apply to development mentioned in section 34(1) if the development is the subject of an EIS process started before the commencement. Section 35(1) does not apply to development that is, or includes, capital dredging if the capital dredging is the subject of an EIS process started before the commencement.
