### sec.19 Port overlay required
As soon as practicable after a master plan takes effect for a priority port, the Minister must make an instrument under this division (a port overlay ) for the priority port’s master planned area.
The port overlay must—
identify the master planned area to which it applies; and
apply to all of the master planned area.
The Minister must be satisfied the port overlay implements the master plan for the master planned area.
However, a port overlay can not regulate development that is—
PDA assessable development or PDA accepted development for a priority development area under the Economic Development Act ; or
regulated development for a State development area under the State Development Act .

(sec.19-ssec.1) As soon as practicable after a master plan takes effect for a priority port, the Minister must make an instrument under this division (a port overlay ) for the priority port’s master planned area.
(sec.19-ssec.2) The port overlay must— identify the master planned area to which it applies; and apply to all of the master planned area.
(sec.19-ssec.3) The Minister must be satisfied the port overlay implements the master plan for the master planned area.
(sec.19-ssec.4) However, a port overlay can not regulate development that is— PDA assessable development or PDA accepted development for a priority development area under the Economic Development Act ; or regulated development for a State development area under the State Development Act .
- (a) identify the master planned area to which it applies; and
- (b) apply to all of the master planned area.
