### sec.75 Carrying out cadastral surveys
A person who is not a registrant must not carry out a cadastral survey.
Maximum penalty—100 penalty units.
A person who is a registrant must not carry out a cadastral survey if the person is not a cadastral surveyor.
Maximum penalty—100 penalty units.
However, a person does not commit an offence against subsection (2) if—
the person carries out the cadastral survey under the supervision of a cadastral surveyor; and
the level of supervision by the cadastral surveyor complies with a guideline mentioned in section 188A (2) (a) .
In this section—
registrant does not include an emeritus surveyor.

(sec.75-ssec.1) A person who is not a registrant must not carry out a cadastral survey. Maximum penalty—100 penalty units.
(sec.75-ssec.2) A person who is a registrant must not carry out a cadastral survey if the person is not a cadastral surveyor. Maximum penalty—100 penalty units.
(sec.75-ssec.3) However, a person does not commit an offence against subsection (2) if— the person carries out the cadastral survey under the supervision of a cadastral surveyor; and the level of supervision by the cadastral surveyor complies with a guideline mentioned in section 188A (2) (a) .
(sec.75-ssec.4) In this section— registrant does not include an emeritus surveyor.
- (a) the person carries out the cadastral survey under the supervision of a cadastral surveyor; and
- (b) the level of supervision by the cadastral surveyor complies with a guideline mentioned in section 188A (2) (a) .
