### sec.53 Failure to decide application
The board is taken to have decided to refuse to grant an application if—
unless paragraph (b) applies, the board fails to decide the application within 40 business days after receiving it; or
the board—
under section 48 , required the applicant to give the board further information or a document; and
fails to decide the application within 40 business days after receiving the information or document.
As soon as practicable after it is taken to have made the decision, the board must refund the registration fee paid by the applicant.
The board need not give an applicant an information notice for a decision taken to have been made under this section.
