#### 27 Age of birth mother 27 Age of birth mother > > (1) The birth mother must have been at least 25 years old when she entered into the surrogacy arrangement. > > > (2) For a pre-commencement surrogacy arrangement, it is sufficient that the birth mother was at least 18 years old when she entered into the surrogacy arrangement. > > > (3) In all cases, it is a mandatory precondition to the making of a parentage order that the birth mother was at least 18 years old when she entered into the surrogacy arrangement.
