### sec.32 Maintaining roads crossing railways
A railway manager must maintain—
a part of the railway on a road; and
the surface of the road, in a character in keeping with the road—
between the rails; and
outside the outermost rails to a distance of 2m.
If a part of the railway is built by way of a bridge or other structure over or under a road, the authority that maintained the road before the railway was built must continue to maintain the road over or under the bridge or structure.
If there is no railway manager, the railway licensee or railway lessee must comply with subsection (1) .
If there is no railway manager, railway licensee and railway lessee, the authority that maintained the road before the railway was built must comply with subsection (1) (b) .
(sec.32-ssec.1) A railway manager must maintain— a part of the railway on a road; and the surface of the road, in a character in keeping with the road— between the rails; and outside the outermost rails to a distance of 2m.
(sec.32-ssec.2) If a part of the railway is built by way of a bridge or other structure over or under a road, the authority that maintained the road before the railway was built must continue to maintain the road over or under the bridge or structure.
(sec.32-ssec.3) If there is no railway manager, the railway licensee or railway lessee must comply with subsection (1) .
(sec.32-ssec.4) If there is no railway manager, railway licensee and railway lessee, the authority that maintained the road before the railway was built must comply with subsection (1) (b) .
- (a) a part of the railway on a road; and
- (b) the surface of the road, in a character in keeping with the road— (i) between the rails; and (ii) outside the outermost rails to a distance of 2m.
- (i) between the rails; and
- (ii) outside the outermost rails to a distance of 2m.
- (i) between the rails; and
- (ii) outside the outermost rails to a distance of 2m.
