> > (1) A defence under [section 9(2) of the](/view/html/inforce/2026-04-12/act-1957-042#GS9@Gs2@EN) [Defamation Act 1957](/view/html/inforce/2026-04-12/act-1957-042) or [section 33 of the](/view/html/inforce/2026-04-12/act-2005-073#GS33@EN) [Defamation Act 2005](/view/html/inforce/2026-04-12/act-2005-073) is sufficiently pleaded if it alleges that the circumstances of publication of the matter complained of were such that the plaintiff was unlikely to sustain any harm.
