### sec.63 Access right to harvest and supply cane
This part provides for the grant by a landholder or the Land Court of 2 types of right (each an access right )—
a permit to pass; and
a cane railway easement.
A permit (a permit to pass ) may be granted to—
a grower to facilitate harvest of cane and supply to a mill; or
a mill owner to facilitate harvest of cane and supply of cane to any mill or between any mills or to service a cane railway easement.
A permit to pass authorises the person to whom it is granted and a person acting on the person’s behalf to use another person’s land under the permit’s conditions.
A permit to pass must state the period for which it has effect.
An easement (a cane railway easement ) may be granted to a mill owner to facilitate harvest of cane and supply of cane to any mill or between any mills.
A cane railway easement may be granted whether or not it is annexed to or used and enjoyed together with any other land.
The grant of an access right is subject to the powers under the Transport Infrastructure Act 1994 of the chief executive or a railway manager within the meaning of that Act.
