### sec.16 Guarantees for the State
For the State, the Treasurer may guarantee the performance of obligations of a statutory body under a financial arrangement entered into by the body under this Act or another Act.
Under section 76 , the Treasurer may delegate the Treasurer’s powers under this part to another Minister.
The guarantee may—
apply generally to all statutory bodies, powers and matters or be limited in its application to—
particular bodies, powers or matters; or
particular classes of bodies, powers or matters; or
otherwise apply generally or be limited in its application by reference to specified exceptions or factors.
Also, the guarantee may—
make different provision for different statutory bodies, powers or matters, or different classes of bodies, powers or matters; or
apply differently to stated exceptions or factors.
The guarantee must be in writing and, if it applies generally or the Treasurer considers it appropriate, may be given by gazette notice.
In giving a guarantee, the Treasurer may do all things necessary for, or incidental to, giving the guarantee.
To remove any doubt, it is declared that a guarantee under subsection (1) may apply to a statutory body even though the body was not established when the guarantee was given.
