### sec.38 Recovery of expenses
The expenses, or such part thereof as is determined by the chief executive, incurred by the chief executive in respect of any inspection of or test carried out on any part of a people mover system pursuant to section 28 (1) shall be a debt due and owing to the State by—
where a licence is not issued under part 4 in respect of the system or the licence is cancelled—the owner of the system;
where a licence is issued under part 4 in respect of the system, including where the licence is suspended—the operator of the system;
and may be recovered in any court of competent jurisdiction.

- (a) where a licence is not issued under part 4 in respect of the system or the licence is cancelled—the owner of the system;
- (b) where a licence is issued under part 4 in respect of the system, including where the licence is suspended—the operator of the system;
