### sec.17 Construction and operation of people mover system
After the expiration of 3 months from the commencement of this Act, a people mover system or any part thereof—
shall not be constructed otherwise than pursuant to an agreement entered into with the chief executive;
shall not be operated for the carriage of passengers except under the authority of and in accordance with a licence issued by the chief executive and in this part referred to as a licence .
A person who commits an offence referred to in subsection (1) (a) or (b) is liable—
in the case of an individual—
for a first offence—to a penalty of 100 penalty units and, in addition, where the offence is a continuing one, a daily penalty of 10 penalty units;
for a second or subsequent offence—to a penalty of 200 penalty units and, in addition, where the offence is a continuing one, a daily penalty of 20 penalty units;
in the case of a body corporate—
for a first offence—to a penalty of 200 penalty units and, in addition, where the offence is a continuing one, a daily penalty of 20 penalty units;
for a second or subsequent offence—to a penalty of 400 penalty units and, in addition, where the offence is a continuing one, a daily penalty of 40 penalty units.

- (ii) for a second or subsequent offence—to a penalty of 400 penalty units and, in addition, where the offence is a continuing one, a daily penalty of 40 penalty units.
