### sec.76E Declaration of prescribed project
The Minister may declare any of the following (each a project ) to be a prescribed project—
works a local body, the Coordinator-General or other person is directed to undertake under section 100 or 109 ;
a project in a State development area;
an infrastructure facility;
a project declared under section 26 to be a coordinated project;
another project the Minister considers—
is economically or socially significant to the State or the region in which the project is to be undertaken; or
affects an environmental interest of the State or a region.
In deciding to declare a project to be a prescribed project, the Minister may have regard to any of the following—
the public interest or the general welfare of persons in the region in which the project is to be undertaken;
whether a voluntary environmental agreement is likely to be entered into in relation to the undertaking of the project;
other matters the Minister considers relevant.
The declaration must be made by gazette notice.
If the Minister considers the undertaking of the project is critical or essential for the State for economic, environmental or social reasons, the Minister may, in the gazette notice, declare the project to be a critical infrastructure project.
This section applies subject to section 76EA .

(sec.76E-ssec.4) If the Minister considers the undertaking of the project is critical or essential for the State for economic, environmental or social reasons, the Minister may, in the gazette notice, declare the project to be a critical infrastructure project.
(sec.76E-ssec.5) This section applies subject to section 76EA .
