### sec.46 Coordinator-General’s conditions override other conditions This section applies if— the proposed mining lease is granted; and the conditions of the mining lease include a Coordinator-General’s condition; and there is any inconsistency between the Coordinator-General’s condition and another condition of the mining lease. The Co-ordinator-General’s condition prevails to the extent of the inconsistency. In this section— Coordinator-General’s condition means— a Coordinator-General’s condition that, under section 45 , is taken to have been included in the proposed mining lease; or a condition that is substantially the same as a condition mentioned in paragraph (a) . s 46 prev s 46 om 1978 No. 62 s 14 (b) pres s 46 ins 1999 No. 32 s 7 sub 2001 No. 46 s 42 amd 2014 No. 47 s 650 (sec.46-ssec.1) This section applies if— the proposed mining lease is granted; and the conditions of the mining lease include a Coordinator-General’s condition; and there is any inconsistency between the Coordinator-General’s condition and another condition of the mining lease. (sec.46-ssec.2) The Co-ordinator-General’s condition prevails to the extent of the inconsistency. (sec.46-ssec.3) In this section— Coordinator-General’s condition means— a Coordinator-General’s condition that, under section 45 , is taken to have been included in the proposed mining lease; or a condition that is substantially the same as a condition mentioned in paragraph (a) . - (a) the proposed mining lease is granted; and - (b) the conditions of the mining lease include a Coordinator-General’s condition; and - (c) there is any inconsistency between the Coordinator-General’s condition and another condition of the mining lease. - (a) a Coordinator-General’s condition that, under section 45 , is taken to have been included in the proposed mining lease; or - (b) a condition that is substantially the same as a condition mentioned in paragraph (a) .
