### sec.99BRCT Offset or refund requirements This section applies if— trunk infrastructure the subject of a necessary infrastructure condition services, or is planned to service, premises other than the subject premises; and an adopted charge applies for the trunk infrastructure. If the cost of the infrastructure required to be provided under the condition is equal to or less than the amount worked out by applying the adopted charge to the connection, the cost must be offset against that amount. For how the cost is worked out, see sections 99BRCH and 99BRDC . If the cost of the infrastructure required to be provided under the condition is more than the amount worked out by applying the adopted charge to the connection— there is no amount payable by the applicant for the relevant water approval; and the distributor-retailer must refund the applicant an amount equal to the difference between the establishment cost of the trunk infrastructure and the amount worked out by applying the adopted charge to the connection. s 99BRCT ins 2014 No. 36 s 45 amd 2014 No. 64 s 51G (sec.99BRCT-ssec.1) This section applies if— trunk infrastructure the subject of a necessary infrastructure condition services, or is planned to service, premises other than the subject premises; and an adopted charge applies for the trunk infrastructure.
