### sec.91 Rights, liabilities and obligations under easement
To the extent the easement relates to the purposes, the distributor-retailer—
may exercise the same rights as the local government; and
is subject to the same liabilities and obligations as the local government.
However, the rights may be exercised only for the construction, installation, repair, replacement or removal of infrastructure relating to the purposes.
This section does not remove or otherwise affect the local government’s rights, liabilities and obligations under the easement.
The distributor-retailer and the local government may make an agreement about the joint use of the easement.
(sec.91-ssec.1) To the extent the easement relates to the purposes, the distributor-retailer— may exercise the same rights as the local government; and is subject to the same liabilities and obligations as the local government.
(sec.91-ssec.2) However, the rights may be exercised only for the construction, installation, repair, replacement or removal of infrastructure relating to the purposes.
(sec.91-ssec.3) This section does not remove or otherwise affect the local government’s rights, liabilities and obligations under the easement.
(sec.91-ssec.4) The distributor-retailer and the local government may make an agreement about the joint use of the easement.

- (b) is subject to the same liabilities and obligations as the local government.
