### sec.53BA Ownership of water infrastructure that becomes part of land Water infrastructure owned by a distributor-retailer remains its personal property despite— it becoming part of any land; or the sale or other disposal of the land of which it becomes a part. This section applies despite— an Act or law of a State; or a contract, covenant or claim of right under a law of a State. This section is subject to any retransfer of the water infrastructure under chapter 3A . s 53BA ins 2010 No. 20 s 9 amd 2012 No. 1 s 22 (sec.53BA-ssec.1) Water infrastructure owned by a distributor-retailer remains its personal property despite— it becoming part of any land; or the sale or other disposal of the land of which it becomes a part. (sec.53BA-ssec.2) This section applies despite— an Act or law of a State; or a contract, covenant or claim of right under a law of a State. (sec.53BA-ssec.3) This section is subject to any retransfer of the water infrastructure under chapter 3A . - (a) it becoming part of any land; or - (b) the sale or other disposal of the land of which it becomes a part. - (a) an Act or law of a State; or - (b) a contract, covenant or claim of right under a law of a State.
