sec.144Appeals and particular rights to appeal to Planning and Environment Court

### sec.144 Appeals and particular rights to appeal to Planning and Environment Court Subsection (2) applies if— a person started an appeal under former chapter 4C, part 4, division 4 about a matter to the Planning and Environment Court; and the appeal had not been decided before the repealed SPA was repealed. Former chapter 4C, part 4, division 4 and the repealed SPA continue to apply in relation to the appeal. Subsections (4) and (5) apply if— immediately before the commencement, a person had a right to appeal under former chapter 4C, part 4, division 4 to the Planning and Environment Court about a matter; and the person had not, before the commencement, started an appeal under former chapter 4C, part 4, division 4 to the Planning and Environment Court in exercise of the right. The person may, under chapter 4C, part 4, division 4, appeal to the Planning and Environment Court about the matter. Chapter 4C, part 4, division 4 applies in relation to the appeal. See also the Planning and Environment Court Act 2016 , section 76 . s 144 ins 2016 No. 27 s 499 (sec.144-ssec.1) Subsection (2) applies if— a person started an appeal under former chapter 4C, part 4, division 4 about a matter to the Planning and Environment Court; and the appeal had not been decided before the repealed SPA was repealed.
