### sec.139 Overdue charges
This section applies if, on the commencement, a distributor-retailer is owed an amount for all or any of the following for premises—
a charge under the repealed SPA, former section 755K or 755KB;
a charge under an agreement under the repealed SPA, former section 755L, 755M or 755MA.
From the commencement, the amount is taken to be an overdue charge for chapter 2A, part 3.
However, a charge under this section is not recoverable unless the entitlements for the approval or permit under the repealed SPA are exercised.

(sec.139-ssec.1) This section applies if, on the commencement, a distributor-retailer is owed an amount for all or any of the following for premises— a charge under the repealed SPA, former section 755K or 755KB; a charge under an agreement under the repealed SPA, former section 755L, 755M or 755MA.
