### sec.86-oc.2 Order relating to animal kept under by-laws
Where, on application by a body corporate, a lessee, a person having an estate or interest in a lot or an occupier of a lot for an order under this section, the referee considers that an animal kept on a lot or the common property under the by-laws causes a nuisance or hazard to the lessee or occupier of another lot or unreasonably interferes with the use and enjoyment of another lot or of the common property, the referee may—
order the person keeping the animal to cause the animal to be removed from the parcel within a specified time, and afterwards to be kept away from the parcel; or
order the person keeping the animal to take, within a time specified in the order, such action so specified as, in the opinion of the referee, will terminate the nuisance, hazard or unreasonable interference.

- (a) order the person keeping the animal to cause the animal to be removed from the parcel within a specified time, and afterwards to be kept away from the parcel; or
- (b) order the person keeping the animal to take, within a time specified in the order, such action so specified as, in the opinion of the referee, will terminate the nuisance, hazard or unreasonable interference.
