What it does
The South Australian Employment Tribunal Act 2014 establishes the South Australian Employment Tribunal as the central specialist forum for dealing with matters arising from or in the course of employment. Under s 5(1) the Tribunal is formally established, with s 5(2) creating a distinct part that constitutes the Tribunal in Court Session, declared to be a court of record known as the South Australian Employment Court. A further part operates as an industrial relations commission (s 5(4)). Section 6(1) confers jurisdiction (including to try charges for offences) as granted by this or any other Act, with assignment rules in s 6(2) directing criminal matters and specifically assigned cases to the Court Session while allowing the industrial relations commission arm to deal with unassigned matters.
The Act's core function is to provide a unified mechanism for both review of administrative decisions and resolution of disputes. Division 1 of Part 3 (ss 26J-31) governs review jurisdiction, applying where a relevant Act requires review of a decision or where the rules so provide. Under s 27(3) the Tribunal conducts a rehearing, examining the evidence before the original decision-maker, considering any additional evidence it admits, and reaching the "correct or preferable decision" while having regard to the original decision. Section 30 empowers the Tribunal to affirm, vary, set aside and substitute its own decision, or remit the matter with directions. Section 31 adds a power to invite the decision-maker to reconsider at any stage.
For matters falling outside review jurisdiction, Division 2 of Part 3 (s 31A) permits the Tribunal to act as original decision-maker, resolve disputes according to law (including by judgment or declaration), or adopt any other appropriate course. Part 4 supplies the overarching principles and powers. Section 8 lists the main objectives: promoting independent, fair and high-quality decision-making; accessibility; speedy yet just resolution with emphasis on mediation; minimising costs; using straightforward language; acting with minimal formality; and flexibility tailored to each case.
