### sec.38 Offences
A person who—
destroys, mutilates, defaces, removes or alters the position of a survey peg, mark, or pole placed, made, affixed or set up for the purposes of this Act; or
interferes with works undertaken for the purposes of this Act; or
assaults, threatens, intimidates or wilfully obstructs or attempts so to do a person authorised by or pursuant to this Act in the exercise or performance of powers, authorities, functions or duties under this Act or a person assisting that authorised person;
commits an offence against this Act.
A person who fails to comply with a run-off coordination notice or a soil conservation order commits an offence against this Act.
Maximum penalty—20 penalty units.
A person who contravenes or fails to comply with a provision of this Act commits an offence against this Act.
Where no penalty is otherwise expressly provided, a person who commits an offence against this Act is liable to a penalty of not more than 10 penalty units.
