### sec.12N Minor variation of site boundaries
This section applies to an amendment of—
the initial plan of survey of the site by varying the boundary of the site; or
the initial plan of survey of the adjacent site by varying the boundary of the adjacent site.
The Governor in Council may approve the amendment only if—
the Governor in Council considers—
the proposed variation of the boundary is of a minor nature; and
the total area of the site or adjacent site will not be materially changed because of the variation; and
neither the aggregate number of the lots on the plan nor the aggregate voting entitlements for the lots will be changed because of the variation; and
each affected land owner has given the owner’s written consent to the variation.
In this section—
affected land owner means an owner of—
land that is outside the site and is proposed under the relevant application to be within the site; or
land that is outside the adjacent site and is proposed under the relevant application to be within the adjacent site.

(sec.12N-ssec.3) In this section— affected land owner means an owner of— land that is outside the site and is proposed under the relevant application to be within the site; or land that is outside the adjacent site and is proposed under the relevant application to be within the adjacent site.
- (a) the initial plan of survey of the site by varying the boundary of the site; or
- (b) the initial plan of survey of the adjacent site by varying the boundary of the adjacent site.
- (a) the Governor in Council considers— (i) the proposed variation of the boundary is of a minor nature; and (ii) the total area of the site or adjacent site will not be materially changed because of the variation; and
- (i) the proposed variation of the boundary is of a minor nature; and
- (ii) the total area of the site or adjacent site will not be materially changed because of the variation; and
- (b) neither the aggregate number of the lots on the plan nor the aggregate voting entitlements for the lots will be changed because of the variation; and
- (c) each affected land owner has given the owner’s written consent to the variation.
- (i) the proposed variation of the boundary is of a minor nature; and
- (ii) the total area of the site or adjacent site will not be materially changed because of the variation; and
- (a) land that is outside the site and is proposed under the relevant application to be within the site; or
- (b) land that is outside the adjacent site and is proposed under the relevant application to be within the adjacent site.
