### sch.66-sec.17 Repayment of assistance on conditional approval The registered provider must repay the amount of the part-payment of the assistance to the authority if— the provider does not apply for final approval for assistance for the purchase and installation of at least 1 primary measure for the eligible dwelling by the day required under section 23 (2) ; or the provider’s application for final approval for assistance for the eligible dwelling is taken to have been withdrawn under section 24 (3) ; or the authority does not give final approval for assistance for at least 1 primary measure for the eligible dwelling, other than because the authority’s assistance funds are insufficient to pay the assistance; or the provider does not comply with the terms of the assistance agreement. - (a) the provider does not apply for final approval for assistance for the purchase and installation of at least 1 primary measure for the eligible dwelling by the day required under section 23 (2) ; or - (b) the provider’s application for final approval for assistance for the eligible dwelling is taken to have been withdrawn under section 24 (3) ; or - (c) the authority does not give final approval for assistance for at least 1 primary measure for the eligible dwelling, other than because the authority’s assistance funds are insufficient to pay the assistance; or - (d) the provider does not comply with the terms of the assistance agreement.
