### sec.172 Access—protection in respect of offences If access has been given to a document and— the access was required or permitted to be given under this Act; or the access was authorised by a decision-maker, in the genuine belief that the access was required or permitted to be given under this Act; neither the person authorising the access nor any other person concerned in the giving of the access commits a criminal offence merely because of authorising or giving of the access. - (a) the access was required or permitted to be given under this Act; or - (b) the access was authorised by a decision-maker, in the genuine belief that the access was required or permitted to be given under this Act;
