sec.165Third party proceedings

### sec.165 Third party proceedings The information commissioner or a member of the staff of the OIC can not be compelled— to produce an RTI document in third party legal proceedings; or to disclose RTI information in third party legal proceedings. In this section— RTI document means a document received, or created, by the commissioner or a member of the staff of the OIC in performing functions under this Act. RTI information means information that the commissioner or a member of the staff of the OIC obtained in performing functions under this Act. third party legal proceedings means a legal proceeding other than— a legal proceeding started by the commissioner; or a legal proceeding started against the commissioner or a member of the staff of the OIC arising out of the performance of functions under this Act.
