### sch.4-sec.3-oc.2 More than 1 lessor or tenant
This clause applies if more than 1 person is named in item 1 or 2.
Each lessor named in item 1 must perform all of the lessor’s obligations under this agreement.
Each tenant named in item 2—
holds their interest in the tenancy as a joint tenant; and
must perform all of the tenant’s obligations under this agreement; and
is liable to pay the full amount of rent or other amounts owing from the tenant to the lessor under this agreement; and
if a debt arises from any breach of this agreement, may be required to pay the full amount owing to the lessor and not just a part of the debt.
By entering into this agreement as a joint tenant with another person, each tenant expressly authorises every other tenant to sign and give to the lessor any notice affecting their interest in the tenancy, and the lessor may accept and act on the notice as if it had been signed by all tenants without further enquiry.
However, a notice of intention to leave will not be accepted by the lessor if it is not signed by all tenants unless the notice is accompanied by a statutory declaration from the person signing the notice certifying—
all reasonable efforts have been made to seek and obtain a notice from all other tenants; and
all persons named as joint tenants who have not signed the notice have vacated the premises.
