### sec.93B Tribunal order about rent increase
This section applies if a lessor reasonably believes the lessor would be caused undue hardship because the lessor is not able to increase the rent payable under a residential tenancy agreement during the 12-month period mentioned in section 93 (1) .
The lessor may apply to a tribunal for an order mentioned in subsection (3) .
The tribunal may make an order permitting the lessor to increase the rent payable under the residential tenancy agreement by a stated amount.
In deciding the application, the tribunal must have regard to any representation made by a tenant under the residential tenancy agreement about the proposed rent increase and its likely effect on—
the affordability of the premises; and
the tenant’s ability to continue to pay the rent for the premises.
This section does not apply in relation to an exempt lessor or an agent of an exempt lessor.

- (b) the tenant’s ability to continue to pay the rent for the premises.
