### sec.397 Application of pt 1 This part applies if there is an issue in dispute relating to a residential tenancy agreement (a tenancy dispute ) and the lessor and tenant have been unable to resolve the dispute through negotiation. This part also applies if there is an issue in dispute relating to a rooming accommodation agreement (a rooming accommodation dispute ) and the provider and resident have been unable to resolve the dispute— through negotiation; or if there is a dispute resolution process operating for the rooming accommodation, by using that process. (sec.397-ssec.1) This part applies if there is an issue in dispute relating to a residential tenancy agreement (a tenancy dispute ) and the lessor and tenant have been unable to resolve the dispute through negotiation. (sec.397-ssec.2) This part also applies if there is an issue in dispute relating to a rooming accommodation agreement (a rooming accommodation dispute ) and the provider and resident have been unable to resolve the dispute— through negotiation; or if there is a dispute resolution process operating for the rooming accommodation, by using that process. - (a) through negotiation; or - (b) if there is a dispute resolution process operating for the rooming accommodation, by using that process.
