### sec.12 Residential tenancy agreement
A residential tenancy agreement is an agreement under which a person gives to someone else a right to occupy residential premises as a residence.
Subsection (1) applies whether or not the right is a right of exclusive occupation.
Subsection (1) also applies whether the agreement is—
wholly in writing, wholly oral or wholly implied; or
partly in a form mentioned in paragraph (a) and partly in 1 or both of the other forms.
An agreement is not a residential tenancy agreement if it is a rooming accommodation agreement.
However, an agreement is a residential tenancy agreement if it is taken to be a residential tenancy agreement under section 18 .
(sec.12-ssec.1) A residential tenancy agreement is an agreement under which a person gives to someone else a right to occupy residential premises as a residence.
(sec.12-ssec.2) Subsection (1) applies whether or not the right is a right of exclusive occupation.
(sec.12-ssec.3) Subsection (1) also applies whether the agreement is— wholly in writing, wholly oral or wholly implied; or partly in a form mentioned in paragraph (a) and partly in 1 or both of the other forms.
(sec.12-ssec.4) An agreement is not a residential tenancy agreement if it is a rooming accommodation agreement.
(sec.12-ssec.5) However, an agreement is a residential tenancy agreement if it is taken to be a residential tenancy agreement under section 18 .
- (a) wholly in writing, wholly oral or wholly implied; or
- (b) partly in a form mentioned in paragraph (a) and partly in 1 or both of the other forms.
