### sec.111 Meaning of rental bond
A rental bond is an amount—
for a residential tenancy agreement—
paid by or for the tenant under the agreement; and
intended to be available for the financial protection of the lessor against the tenant breaching the agreement; or
for a rooming accommodation agreement—
paid by or for the resident under the agreement; and
intended to be available for the financial protection of the provider against the resident breaching the agreement.
However, a rental bond does not include rent paid in advance.
In deciding whether an amount is a rental bond, it does not matter—
when the amount is paid; or
if the amount is paid directly to the authority; or
to or by whom the amount is paid; or
how the amount is described in the residential tenancy agreement or rooming accommodation agreement about the payment of the amount.
A rental bond includes a part of a rental bond.

(sec.111-ssec.1) A rental bond is an amount— for a residential tenancy agreement— paid by or for the tenant under the agreement; and intended to be available for the financial protection of the lessor against the tenant breaching the agreement; or for a rooming accommodation agreement— paid by or for the resident under the agreement; and intended to be available for the financial protection of the provider against the resident breaching the agreement.
(sec.111-ssec.2) However, a rental bond does not include rent paid in advance.
(sec.111-ssec.3) In deciding whether an amount is a rental bond, it does not matter— when the amount is paid; or if the amount is paid directly to the authority; or to or by whom the amount is paid; or how the amount is described in the residential tenancy agreement or rooming accommodation agreement about the payment of the amount.
(sec.111-ssec.4) A rental bond includes a part of a rental bond.
- (a) for a residential tenancy agreement— (i) paid by or for the tenant under the agreement; and (ii) intended to be available for the financial protection of the lessor against the tenant breaching the agreement; or
- (i) paid by or for the tenant under the agreement; and
- (ii) intended to be available for the financial protection of the lessor against the tenant breaching the agreement; or
- (b) for a rooming accommodation agreement— (i) paid by or for the resident under the agreement; and (ii) intended to be available for the financial protection of the provider against the resident breaching the agreement.
- (i) paid by or for the resident under the agreement; and
- (ii) intended to be available for the financial protection of the provider against the resident breaching the agreement.
- (i) paid by or for the tenant under the agreement; and
- (ii) intended to be available for the financial protection of the lessor against the tenant breaching the agreement; or
- (i) paid by or for the resident under the agreement; and
- (ii) intended to be available for the financial protection of the provider against the resident breaching the agreement.
- (a) when the amount is paid; or
- (b) if the amount is paid directly to the authority; or
- (c) to or by whom the amount is paid; or
- (d) how the amount is described in the residential tenancy agreement or rooming accommodation agreement about the payment of the amount.
