### sec.87 Authorised persons under a Local Government Act
This section applies for a priority living area.
The functions of an authorised person (local government) under the Local Government Act 2009 or the City of Brisbane Act 2010 include to ensure compliance with this Act (the further function ).
For the purposes of subsection (2) —
an authorised person under the Local Government Act 2009 may exercise the person’s powers under chapter 5 , part 2 , division 1 of that Act to perform the further function; and
an authorised person under the City of Brisbane Act 2010 may exercise the person’s powers under chapter 5 , part 2 , division 1 of that Act to perform the further function; and
on an application by an authorised person (local government), a magistrate may issue a warrant for a place under section 130 of the Local Government Act 2009 or section 119 of the City of Brisbane Act 2010 only if the magistrate is satisfied there are reasonable grounds for suspecting—
there is a particular thing or activity (the evidence ) that may provide evidence of an offence against this Act; and
the evidence is at the place or, within the next 7 days, may be at the place; and
a reference in the Local Government Act 2009 or the City of Brisbane Act 2010 to the Local Government Acts is taken to include a reference to this Act.
In this section—
authorised person (local government) means an authorised person under the Local Government Act 2009 or the City of Brisbane Act 2010 .
(sec.87-ssec.1) This section applies for a priority living area.
(sec.87-ssec.2) The functions of an authorised person (local government) under the Local Government Act 2009 or the City of Brisbane Act 2010 include to ensure compliance with this Act (the further function ).
(sec.87-ssec.3) For the purposes of subsection (2) — an authorised person under the Local Government Act 2009 may exercise the person’s powers under chapter 5 , part 2 , division 1 of that Act to perform the further function; and an authorised person under the City of Brisbane Act 2010 may exercise the person’s powers under chapter 5 , part 2 , division 1 of that Act to perform the further function; and on an application by an authorised person (local government), a magistrate may issue a warrant for a place under section 130 of the Local Government Act 2009 or section 119 of the City of Brisbane Act 2010 only if the magistrate is satisfied there are reasonable grounds for suspecting— there is a particular thing or activity (the evidence ) that may provide evidence of an offence against this Act; and the evidence is at the place or, within the next 7 days, may be at the place; and a reference in the Local Government Act 2009 or the City of Brisbane Act 2010 to the Local Government Acts is taken to include a reference to this Act.
(sec.87-ssec.4) In this section— authorised person (local government) means an authorised person under the Local Government Act 2009 or the City of Brisbane Act 2010 .
- (a) an authorised person under the Local Government Act 2009 may exercise the person’s powers under chapter 5 , part 2 , division 1 of that Act to perform the further function; and
- (b) an authorised person under the City of Brisbane Act 2010 may exercise the person’s powers under chapter 5 , part 2 , division 1 of that Act to perform the further function; and
- (c) on an application by an authorised person (local government), a magistrate may issue a warrant for a place under section 130 of the Local Government Act 2009 or section 119 of the City of Brisbane Act 2010 only if the magistrate is satisfied there are reasonable grounds for suspecting— (i) there is a particular thing or activity (the evidence ) that may provide evidence of an offence against this Act; and (ii) the evidence is at the place or, within the next 7 days, may be at the place; and
- (i) there is a particular thing or activity (the evidence ) that may provide evidence of an offence against this Act; and
- (ii) the evidence is at the place or, within the next 7 days, may be at the place; and
- (d) a reference in the Local Government Act 2009 or the City of Brisbane Act 2010 to the Local Government Acts is taken to include a reference to this Act.
- (i) there is a particular thing or activity (the evidence ) that may provide evidence of an offence against this Act; and
- (ii) the evidence is at the place or, within the next 7 days, may be at the place; and
