### sec.52 Proceedings for recovery of unpaid fees
This section applies in relation to a person who has not paid a fee when it is payable under the Act .
A proceeding may be started against the person for the recovery of the fee, or part of the fee, whether or not—
a prosecution has been started against the person for an offence relating to the failure to pay the fee; or
the person has been convicted of an offence relating to the failure to pay the fee.
A fee payable under the Act is a debt due to the State.
(sec.52-ssec.1) This section applies in relation to a person who has not paid a fee when it is payable under the Act .
(sec.52-ssec.2) A proceeding may be started against the person for the recovery of the fee, or part of the fee, whether or not— a prosecution has been started against the person for an offence relating to the failure to pay the fee; or the person has been convicted of an offence relating to the failure to pay the fee.
(sec.52-ssec.3) A fee payable under the Act is a debt due to the State.
- (a) a prosecution has been started against the person for an offence relating to the failure to pay the fee; or
- (b) the person has been convicted of an offence relating to the failure to pay the fee.
