### sec.17 Effect of declaration of recreation area on mining interests
The inclusion of land in a recreation area does not prevent a person from obtaining a mining interest over the land if the person could otherwise have obtained the interest.
Also, this Act does not operate to restrict the entry of a person on land in a recreation area under the authority of a mining interest over the land.
In this section—
mining interest includes—
a prospecting permit or an exploration permit under the Mineral Resources Act 1989 ; and
an authority to prospect under the Petroleum Act 1923 ; and
an authority of a type mentioned in the Petroleum and Gas (Production and Safety) Act 2004 , section 18 .
(sec.17-ssec.1) The inclusion of land in a recreation area does not prevent a person from obtaining a mining interest over the land if the person could otherwise have obtained the interest.
