### sec.101 Immediate declaration of restricted access area
The chief executive may declare all or part of a recreation area to be a restricted access area by erecting or displaying a notice (a restricted access area notice ) in, at or near an entrance to the restricted access area.
The chief executive may make the declaration only if the chief executive considers that access to, or activity in, the restricted access area should immediately be restricted or prohibited—
to secure the safety of a person or a person’s property; or
because of a fire or other natural disaster; or
to conserve or protect the cultural or natural resources of the recreation area or native wildlife.
The restricted access area notice must—
be easily visible to passers-by; and
specify the limits of the area to which the notice applies; and
state how access to, or activity in, the area is restricted or prohibited; and
state that a contravention of a requirement of the notice is an offence against this Act and the penalty for the offence.
When the notice is erected or displayed, the chief executive—
must publish a copy of the notice on the department’s website; and
may publish the notice in other ways the chief executive considers appropriate.
If the chief executive is satisfied the reason for making the declaration no longer exists, the chief executive must remove the restricted access area notice as soon as practicable.
