### sec.93 Compliance with requirements for assessment of competence
A rail transport operator can not be prosecuted for an offence against the national law, section 117(1) if the act or omission constituting the offence—
occurs during the transitional period; and
had it occurred before the commencement, would not have constituted an offence against the repealed Act, section 87(1).
A rail transport operator can not be prosecuted for an offence against the national law, section 117(6) if the act or omission constituting the offence—
occurs during the transitional period; and
had it occurred before the commencement, would not have constituted an offence against the repealed Act, section 87(4).
In this section—
transitional period means the period starting on the commencement and ending 2 years later.
(sec.93-ssec.1) A rail transport operator can not be prosecuted for an offence against the national law, section 117(1) if the act or omission constituting the offence— occurs during the transitional period; and had it occurred before the commencement, would not have constituted an offence against the repealed Act, section 87(1).
(sec.93-ssec.2) A rail transport operator can not be prosecuted for an offence against the national law, section 117(6) if the act or omission constituting the offence— occurs during the transitional period; and had it occurred before the commencement, would not have constituted an offence against the repealed Act, section 87(4).
(sec.93-ssec.3) In this section— transitional period means the period starting on the commencement and ending 2 years later.
- (a) occurs during the transitional period; and
- (b) had it occurred before the commencement, would not have constituted an offence against the repealed Act, section 87(1).
