### sec.69 Compliance with registration conditions
A rail transport operator to whom section 68(1) of this Act applies can not be prosecuted for an offence against the national law, section 214 if the act or omission constituting the offence—
occurs during the transitional period; and
had it occurred before the commencement, would not have constituted an offence against the repealed Act, section 48(2).
In this section—
transitional period means the period starting on the commencement and ending 3 years later.
(sec.69-ssec.1) A rail transport operator to whom section 68(1) of this Act applies can not be prosecuted for an offence against the national law, section 214 if the act or omission constituting the offence— occurs during the transitional period; and had it occurred before the commencement, would not have constituted an offence against the repealed Act, section 48(2).
(sec.69-ssec.2) In this section— transitional period means the period starting on the commencement and ending 3 years later.

- (b) had it occurred before the commencement, would not have constituted an offence against the repealed Act, section 48(2).
