### sec.43 Certificate about failure to allow health care professional to take specimen of blood
This section applies if—
a rail safety worker is directed under this part to provide a specimen of the worker’s blood for a laboratory test; and
the worker fails to allow a health care professional to take the specimen as required under section 35 ; and
the health care professional witnessed the giving of the direction.
As soon as practicable after the rail safety worker fails to provide the specimen, the health care professional must sign 2 copies of a certificate in writing stating each of the following—
the name of the rail safety worker;
the name of the authorised person who gave the direction;
the name of the health care professional;
that the health care professional witnessed the giving of the direction;
that the worker failed to allow the health care professional to take the specimen;
details of the worker’s failure to allow the health care professional to take the specimen.
(sec.43-ssec.1) This section applies if— a rail safety worker is directed under this part to provide a specimen of the worker’s blood for a laboratory test; and the worker fails to allow a health care professional to take the specimen as required under section 35 ; and the health care professional witnessed the giving of the direction.
(sec.43-ssec.2) As soon as practicable after the rail safety worker fails to provide the specimen, the health care professional must sign 2 copies of a certificate in writing stating each of the following— the name of the rail safety worker; the name of the authorised person who gave the direction; the name of the health care professional; that the health care professional witnessed the giving of the direction; that the worker failed to allow the health care professional to take the specimen; details of the worker’s failure to allow the health care professional to take the specimen.
- (a) a rail safety worker is directed under this part to provide a specimen of the worker’s blood for a laboratory test; and
- (b) the worker fails to allow a health care professional to take the specimen as required under section 35 ; and
- (c) the health care professional witnessed the giving of the direction.

- (d) that the health care professional witnessed the giving of the direction;
- (e) that the worker failed to allow the health care professional to take the specimen;
- (f) details of the worker’s failure to allow the health care professional to take the specimen.
