### sec.20 Limitation on when authorised person may exercise powers in relation to train driver
An authorised person may not exercise a power under division 3 or 4 in relation to a train driver if a police officer is exercising a power under the Transport Operations (Road Use Management) Act 1995 , section 80 in relation to the train driver.
In this section—
train driver means a rail safety worker—
found by a police officer driving, attempting to put in motion, or in charge of, a train as mentioned in the Transport Operations (Road Use Management) Act 1995 , section 80 (2) or (2A) ; or
who a police officer reasonably suspects was driving, attempting to put in motion, or in charge of, a train in the circumstances mentioned in section 80 (2) or (2A) of that Act.
(sec.20-ssec.1) An authorised person may not exercise a power under division 3 or 4 in relation to a train driver if a police officer is exercising a power under the Transport Operations (Road Use Management) Act 1995 , section 80 in relation to the train driver.
(sec.20-ssec.2) In this section— train driver means a rail safety worker— found by a police officer driving, attempting to put in motion, or in charge of, a train as mentioned in the Transport Operations (Road Use Management) Act 1995 , section 80 (2) or (2A) ; or who a police officer reasonably suspects was driving, attempting to put in motion, or in charge of, a train in the circumstances mentioned in section 80 (2) or (2A) of that Act.
- (a) found by a police officer driving, attempting to put in motion, or in charge of, a train as mentioned in the Transport Operations (Road Use Management) Act 1995 , section 80 (2) or (2A) ; or
- (b) who a police officer reasonably suspects was driving, attempting to put in motion, or in charge of, a train in the circumstances mentioned in section 80 (2) or (2A) of that Act.
