### sec.44A Additional obligations of persons for security enhanced sources This section applies to the following persons— a possession licensee who, under the licence, possesses a security enhanced source; the possession licensee’s employees and other persons who have access, or control access, to the source under the licensee’s approved security plan or approved transport security plan for the source; other persons to whom the possession licensee’s approved security plan or approved transport security plan applies; a transport licensee who is transporting 2 or more radioactive substances that have become a security enhanced source as a result of their aggregation; the transport licensee’s employees and other persons who have access, or control access, to the source under the licensee’s approved transport security plan for the source; other persons to whom the transport licensee’s approved transport security plan applies; another person (the transporter ) who is transporting 2 or more radiation sources that have become a security enhanced source as a result of their aggregation; the transporter’s employees and other persons who have access, or control access, to the source under the transporter’s approved transport security plan for the source; other persons to whom the transporter’s approved transport security plan applies. A person to whom this section applies must take reasonable steps to ensure the security of the security enhanced source. Maximum penalty—2,500 penalty units. Without limiting the ways in which a person may comply with subsection (2) , a person is taken to comply with subsection (2) if, at the relevant time, the person is complying with the parts of the following that apply to the person— the licensee’s approved security plan; an approved transport security plan applying to the transport of the source.
