### sec.34N Changing approved transport security plan—chief executive’s initiative
The chief executive may change an approved transport security plan if the chief executive considers it necessary or desirable to make the change having regard to the requirements for a transport security plan mentioned in section 34H (2) .
Before changing the plan, the chief executive must—
give a written notice to the transport security plan holder, stating—
the particulars of the proposed change; and
the day it is proposed the change is to take effect; and
that the transport security plan holder may make written submissions to the chief executive about the proposed change before a stated day; and
have regard to written submissions made to the chief executive by the transport security plan holder before the stated day.
The stated day must not be earlier than 21 days after the notice is given to the transport security plan holder.
If the chief executive decides to change the plan, the chief executive must immediately give the transport security plan holder an information notice about the decision.
The change takes effect on the day stated for the change in the information notice and does not depend on the plan being amended to incorporate the change.
The day mentioned in subsection (5) must not be earlier than 35 days after the notice is given to the transport security plan holder.
