### sec.50 Protection from liability
A protected person does not incur civil liability for an act done, or omission made, honestly and without negligence under this Act.
If subsection (1) prevents a civil liability attaching to the protected person, the liability instead attaches to the State.
This section does not apply to a protected person if the person is a State employee within the meaning of the Public Service Act 2008 , section 26B (4) .

In this section—
protected person means—
the Minister; or
a member.
(sec.50-ssec.1) A protected person does not incur civil liability for an act done, or omission made, honestly and without negligence under this Act.
(sec.50-ssec.2) If subsection (1) prevents a civil liability attaching to the protected person, the liability instead attaches to the State.
(sec.50-ssec.3) This section does not apply to a protected person if the person is a State employee within the meaning of the Public Service Act 2008 , section 26B (4) . For protection from civil liability in relation to State employees, see the Public Service Act 2008 , section 26C .
(sec.50-ssec.4) In this section— protected person means— the Minister; or a member.
