### sec.93 Designation of premises—development scheme
To remove any doubt, it is declared that—
the planning Minister or a local government may make a designation under the Planning Act , chapter 2 , part 5 of premises in, or partly in, the area to which a development scheme applies; and
a designation of premises under the Planning Act that is in force immediately before a development scheme takes effect for all or part of the premises continues in force despite the development scheme taking effect.
Development carried out on premises that are the subject of a designation under the Planning Act is accepted development to the extent the development—
is carried out under the designation; and
would, other than for this subsection, be assessable development under a development scheme.
Subsection (2) does not limit the Planning Act , section 44 (6) (b) .
In this section—
planning Minister means the Minister administering the Planning Act .

(sec.93-ssec.2) Development carried out on premises that are the subject of a designation under the Planning Act is accepted development to the extent the development— is carried out under the designation; and would, other than for this subsection, be assessable development under a development scheme.
(sec.93-ssec.3) Subsection (2) does not limit the Planning Act , section 44 (6) (b) .

- (b) a designation of premises under the Planning Act that is in force immediately before a development scheme takes effect for all or part of the premises continues in force despite the development scheme taking effect.
- (a) is carried out under the designation; and
- (b) would, other than for this subsection, be assessable development under a development scheme.
