### sec.42 Declaration of declared project
The Minister may declare a project for proposed development to be a declared project if the Minister is satisfied—
the project is to be undertaken in a part of the State that has been directly or indirectly affected by a disaster; and
the declaration is necessary to facilitate—
the protection, rebuilding and recovery of an affected community; or
mitigating against potential disasters for an affected community; or
improving the resilience of an affected community for potential disasters through, for example, the betterment of the community.
The declaration must be made by gazette notice.
The gazette notice must describe the land to which the declared project relates.

Before declaring a declared project, the Minister must have regard to the responsibilities of the relevant local government for matters about land use, and the giving of development approvals, for the local government’s area.
