### sec.11 Eligibility for appointment
A person is eligible for appointment as a tribunal member only if the person—
has extensive knowledge of, and experience in, 1 or more of the following—
State government;
community affairs;
human resource management;
industrial relations;
law;
public administration;
public finance;
public sector ethics; or
has other knowledge and experience the Governor in Council considers appropriate.
However, a person is not eligible for appointment as a tribunal member if the person—
is a member or former member of the Assembly or a spouse of a member or former member; or
is a candidate for election as a member of the Assembly; or
is employed under the Public Sector Act 2022 or the Parliamentary Service Act 1988 ; or
is a member of the Parliament of the Commonwealth or another State or a Territory; or
is a candidate for election as a member of the Parliament of the Commonwealth or another State or a Territory; or
is a councillor of a local government, or a candidate for election as a councillor; or
accepts an appointment as a councillor; or
is an employee of a local government; or
is a member or employee of a political party; or
is an insolvent under administration; or
has a conviction, other than a spent conviction, for an indictable offence.

(sec.11-ssec.1) A person is eligible for appointment as a tribunal member only if the person— has extensive knowledge of, and experience in, 1 or more of the following— State government; community affairs; human resource management; industrial relations; law; public administration; public finance; public sector ethics; or has other knowledge and experience the Governor in Council considers appropriate.
(sec.11-ssec.2) However, a person is not eligible for appointment as a tribunal member if the person— is a member or former member of the Assembly or a spouse of a member or former member; or is a candidate for election as a member of the Assembly; or is employed under the Public Sector Act 2022 or the Parliamentary Service Act 1988 ; or is a member of the Parliament of the Commonwealth or another State or a Territory; or is a candidate for election as a member of the Parliament of the Commonwealth or another State or a Territory; or is a councillor of a local government, or a candidate for election as a councillor; or accepts an appointment as a councillor; or is an employee of a local government; or is a member or employee of a political party; or is an insolvent under administration; or has a conviction, other than a spent conviction, for an indictable offence.
- (a) has extensive knowledge of, and experience in, 1 or more of the following— (i) State government; (ii) community affairs; (iii) human resource management; (iv) industrial relations; (v) law; (vi) public administration; (vii) public finance; (viii) public sector ethics; or
- (i) State government;
- (ii) community affairs;
- (iii) human resource management;
- (iv) industrial relations;
- (v) law;
- (vi) public administration;
- (vii) public finance;
- (viii) public sector ethics; or
- (b) has other knowledge and experience the Governor in Council considers appropriate.
- (i) State government;

- (viii) public sector ethics; or
- (a) is a member or former member of the Assembly or a spouse of a member or former member; or
- (b) is a candidate for election as a member of the Assembly; or
- (c) is employed under the Public Sector Act 2022 or the Parliamentary Service Act 1988 ; or
- (d) is a member of the Parliament of the Commonwealth or another State or a Territory; or
- (e) is a candidate for election as a member of the Parliament of the Commonwealth or another State or a Territory; or
- (f) is a councillor of a local government, or a candidate for election as a councillor; or
- (g) accepts an appointment as a councillor; or
- (h) is an employee of a local government; or
- (i) is a member or employee of a political party; or
- (j) is an insolvent under administration; or
- (k) has a conviction, other than a spent conviction, for an indictable offence.
