### sec.108 Refusing an application for a permit to enter a protected area
If the chief executive is not satisfied the application should be approved, the chief executive must—
refuse the application; and
within 10 business days after deciding the application should not be approved, give the applicant written notice of the refusal.
The chief executive may refuse the application if the chief executive is satisfied the applicant—
does not have the necessary expertise or experience to be given the permit; or
does not have a sufficient reason to enter the area; or
is not a suitable person to hold the permit.
the applicant has been convicted of an offence against this Act, another Act dealing with cultural heritage or a similar law of another State, or has held a similar permit that has been cancelled under this Act, another Act dealing with cultural heritage or a similar law of another State
Subsection (2) does not limit the grounds on which the chief executive may refuse the application.

- (a) refuse the application; and
- (b) within 10 business days after deciding the application should not be approved, give the applicant written notice of the refusal.
